1.1 Scope of Services

Riveros Brothers Management LLC (“the Company”) provides a broad range of high-quality services to residential and commercial clients. Our services are designed to enhance the exterior functionality, aesthetics, and durability of your property. The scope of our services includes, but is not limited to:

  • Gutter Installation and Replacement: Seamless gutter installation, downspout systems, gutter guards, and other related components designed for efficient water management.
  • Fences – Building and Repairs:
    • Fence Construction: Custom design and construction of various types of fences including wood and composite material. We provide full installation, including posts, panels, gates, and any other necessary hardware.
    • Fence Repairs: We offer repair services for damaged fences, including post replacements, panel repairs, painting, staining, and other maintenance services to restore the fence’s functionality and appearance.
    • Types of Fencing Offered:
      • Wood Fencing: Picket, privacy, or split-rail fences
      • Composite fencing: Low-maintenance, eco-friendly decking options such as Trex and TimberTech, providing a longer lifespan with reduced upkeep.
  • Decks – Building and Repairs:
    • Deck Construction: Design and build of custom decks using high-quality materials such as wood, composite, and pressure-treated lumber. We can create decks tailored to your outdoor living needs, including multi-level decks, railing installation, and built-in seating.
    • Deck Repairs: Comprehensive deck repair services, including structural assessments, board replacements, railing repairs, and staining or sealing. We also offer maintenance services to extend the life of your deck.
    • Materials for Deck Construction:
      • Wood Decking: Traditional wood decks made from pressure-treated lumber, cedar, redwood, or tropical hardwoods.
      • Composite Decking: Low-maintenance, eco-friendly decking options such as Trex and TimberTech, providing a longer lifespan with reduced upkeep.

The specific materials, timeline, and detailed scope of work will be outlined in the project estimate and formalized in the final agreement. Any requested changes to the project scope must be documented and signed by both parties.

1.2 Estimates and Proposals

  1. All project proposals issued by the Company are valid for a period of thirty (30) calendar days from the date of issuance, unless otherwise specified in writing.
  2. Estimates are based on information available during the site inspection and may be modified due to unforeseen circumstances including, but not limited to, hidden damage, structural issues, or code compliance requirements discovered during the course of work.
  3. The Company reserves the right to revise estimates to reflect accurate labor and material costs if new conditions emerge that were not previously identified.

1.3 Payment Terms

Deposit Requirement:
A 50% is required to initiate the project. This deposit secures materials, schedules labor, and reserves the required time for your project. Projects will not be scheduled or materials ordered until the deposit is received and processed.

Final Balance:
The remaining balance is due immediately upon completion of the project, unless otherwise agreed upon in writing. The final payment must be made before the completion of any final inspections or warranty activation.

Late Payments:
Failure to remit payment within seven (7) calendar days of project completion will incur a 2% late fee per month on the outstanding balance, compounded monthly. If payment remains unpaid after thirty (30) days, the Company reserves the right to suspend any ongoing work, hold the project completion until paid, and/or pursue legal action to collect any outstanding balances.

Accepted Payment Methods:
Riveros Brothers Management LLC only accepts the following methods of payment:

  • Debit Card
  • Credit Card
  • Zelle
  • Check
  • Cash

Please note that a processing fee of 3.5% of the total project amount, plus an additional $0.10 per transaction, will be applied to payments made via credit or debit card.

Payments made via Zelle will incur no additional processing fees.

Returned payments, including chargebacks or failed Zelle, Debit Card and Credit Card transactions, will incur an additional $35 administrative fee. Repeated instances of non-payment may result in suspension of services and potential legal action.

1.4 Change Orders

Clients may request modifications to the scope of work by submitting a formal Change Order request. All changes:

  • Must be in writing
  • Must receive approval by an authorized Company representative
  • May impact the project cost and timeline

Changes will not be implemented until the Change Order is agreed upon and signed by both parties.

1.5 Access to Property

To ensure timely and efficient completion of services, the client is required to provide reasonable access to the job site during standard business hours (typically 8:00 a.m. to 5:00 p.m., Monday through Friday). If access is delayed or restricted:

  • The project may be rescheduled at the Company’s discretion.
  • Additional fees may be applied for labor rescheduling, material storage, or lost time.

The client is responsible for ensuring the work area is free from obstructions and safe for our team to operate.

1.6 Project Timeline

The Company will provide estimated start and completion dates upon project scheduling. However, timelines are estimates only and subject to change due to:

  • Inclement weather
  • Material delivery delays
  • Permit delays
  • Changes in scope
  • Site accessibility issues
  • Acts of God or emergencies

The Company will communicate changes in scheduling promptly and work to minimize disruption.

1.7 Cancellation Policy

Client-Initiated Cancellations:
If the client cancels the project after materials have been ordered or work has begun, the client may be liable for:

  • The full cost of all non-returnable materials
  • Labor already performed
  • Any administrative or rescheduling fees

Cancellations must be submitted in writing.

1.8 Dispute Resolution

In the event of a disagreement or claim arising out of the services provided, both parties agree to:

  1. Engage in good-faith informal negotiations for a minimum period of 14 days before pursuing formal legal action.
  2. If unresolved, disputes shall be resolved through binding arbitration or litigation in the courts of the State of Texas, County of [Insert County].

Each party shall bear its own legal costs unless otherwise determined by the court or arbitrator.

1.9 Limitation of Liability

To the fullest extent permitted by law:

  • The Company shall not be liable for indirect, incidental, or consequential damages including loss of property use, inconvenience, or financial loss resulting from service delays.
  • Total liability for any claim arising under this Agreement shall not exceed the amount paid by the client for the disputed portion of the services rendered.

1.10 Client Acknowledgment

By making a deposit payment, the client acknowledges and agrees to all terms, conditions, policies, and disclaimers contained in this document. The client further agrees that these Terms and Conditions constitute a legally binding agreement.

2. PRIVACY POLICY

  • Service Delivery: To schedule consultations, provide accurate project estimates, process payments, and execute the scope of work as agreed upon.

  • Invoice and Record Maintenance: For invoicing, record-keeping, and warranty tracking. This also includes sending receipts or tax-related documents.
  • Client Service and Support: To respond to client inquiries, resolve issues, or provide ongoing customer support, including follow-up after project completion.
  • Marketing and Promotions (Optional): If you opt-in, we may use your contact information to send promotional emails, newsletters, or offers. You may opt-out at any time (see Section 2.5 for instructions).

3. WARRANTY INFORMATION

3.1 Labor Warranty

Riveros Brothers Management LLC guarantees that all labor performed under this agreement will be free from defects in workmanship for a period of three (3) years from the date of project completion. This warranty covers:

  • Installation of gutters, downspouts, guards and related components.
  • Any services related to the proper installation, including leveling, sealing, and connections.

If any issues arise within the warranty period related to workmanship (e.g., incorrect installation, visible defects), we will repair or replace the affected components at no additional cost to the client, except as otherwise specified in this section.

3.2 Materials Warranty

Materials supplied and installed by Riveros Brothers are warranted for a period of five (5) years against defects in manufacturing. This includes:

  • Gutter systems made from aluminum, copper, steel, or vinyl.
  • Fences made from wood and/or composite material.
  • Decks made from wood and/or composite material.
  • Fasteners, brackets, seals, downspout connectors, and any other materials supplied by Riveros Brothers.
  • Protective coatings (if applicable).

This warranty is subject to the terms and conditions set by the original material manufacturer. In the event of a material defect, Riveros Brothers will either repair or replace the defective material at no cost to the client, excluding installation fees.

3.3 Warranty Limitations and Exclusions

The following conditions are excluded from coverage under the labor and materials warranties:

  • Acts of God or Natural Disasters: Including hurricanes, earthquakes, floods, hail, and other extreme weather events.
  • Improper Maintenance: Failure to maintain gutters, including but not limited to, not cleaning gutters, allowing blockages, or failing to remove debris that causes clogs or ice dams.
  • Misuse or Abuse: Damages caused by hanging objects from gutters, overloading the system, or intentional alterations.
  • Unauthorized Repairs: Any modifications, repairs, or adjustments to the installed systems performed by anyone other than authorized personnel from Riveros Brothers or our approved agents.
  • Environmental Exposure: Corrosion, fading, or discoloration caused by pollutants, chemicals, or other harsh environmental conditions not typical of residential or commercial use.

3.4 Client Maintenance Responsibility

To keep the warranty valid, the client is responsible for regular maintenance of the installed systems, including:

  • Inspection and Cleaning: Gutters should be cleaned at least twice annually, or more frequently based on the environment (e.g., more frequent cleaning in areas with heavy foliage).
  • Timely Repairs: The client must promptly report any damage or malfunctions that may require attention to ensure continued function of the system.

Failure to comply with these maintenance responsibilities may void the warranty.

3.5 Warranty Claims

If you believe that a warranty issue has occurred, please contact Riveros Brothers Management LLC within 30 days of noticing the defect. Claims should be submitted by email to [Insert Contact Email], and should include:

4. LICENSED AND INSURED STATEMENT

Riveros Brothers Management LLC is a fully licensed and insured company operating under the laws of the State of Texas.

Licensing

We comply with all local, state, and municipal contractor regulations, including maintaining the necessary contractor licenses and registrations for all services performed. All work is completed in accordance with applicable building codes, industry standards, and safety regulations.

Insurance Coverage

We are fully insured to protect our clients and workers during the course of business. Our coverage includes:

  • General Liability Insurance: Provides protection against property damage or injury caused during the course of the project.
  • Workers’ Compensation Insurance: Covers injuries that may occur to workers while on the job site.
  • Bonding (if applicable): For government projects or large-scale commercial work requiring performance and payment bonds.

Clients may request a Certificate of Insurance (COI) at any time to verify our coverage.
